1. Introduction
Welcome to BeHeard. By accessing or using our app or services, you agree to be bound by these Terms of Service ("Terms"). These Terms govern your access to and use of the BeHeard voice call platform.
2. Definitions
- "BeHeard" refers to the app and related services provided under the BeHeard brand.
- "User" means any person who accesses or uses the platform.
- "Call Participant" refers to either User A (caller) or User B (receiver).
- "Balance" means funds topped up or earned within the BeHeard app.
3. Account Registration
You must be at least 18 years old to use BeHeard. You agree to provide accurate information and maintain the security of your account credentials.
4. Acceptable Use
- No harassment, threats, hate speech, or explicit content.
- No impersonation or account sharing.
- No spamming, fraud, or solicitation.
Violation of these rules may result in suspension or permanent ban.
5. Zero Tolerance for Objectionable Content
BeHeard maintains a strict zero-tolerance policy for objectionable content and abusive behavior. We do not tolerate:
- Harassment, bullying, or threats of any kind
- Hate speech or discrimination based on race, ethnicity, religion, gender, sexual orientation, disability, or any other protected characteristic
- Sexual content, solicitation, or exploitation
- Violence, self-harm, or dangerous activities
- Illegal activities including fraud, drug dealing, or promotion of criminal behavior
- Spam, scams, or deceptive practices
- Sharing of personal information without consent (doxxing)
Users who violate this zero-tolerance policy will be immediately removed from the platform without warning and permanently banned.
All reported content is reviewed within 24 hours. Repeated violations or severe offenses will result in permanent account termination and may be reported to law enforcement.
6. Safety and Community
We provide tools to block and report users. Our system includes profanity filtering, community feedback, and a trust score to help maintain safety. Users can:
- Report inappropriate behavior immediately after a call
- Block abusive users to prevent future contact
- Review community guidelines and safety tips in the app
Our moderation team reviews all reports within 24 hours and takes immediate action against violators.
7. Privacy & Encryption
BeHeard does not record or store your voice calls. All calls are secured with end-to-end encryption. Only call metadata (duration, timestamp, feedback, etc.) is stored for operational purposes.
8. Payments & Earnings
- Users can purchase minutes or credits via Stripe.
- User B earns money based on call time; BeHeard takes a platform fee.
- Stripe fees and taxes may apply. BeHeard is not responsible for incorrect payout details.
All purchases are final unless required by local law.
9. Taxes
You are solely responsible for reporting and paying taxes on earnings received through BeHeard, as required by your local tax authority.
10. Refunds
Refunds are not guaranteed. We may consider refund requests in cases of technical failure or fraud, at our sole discretion.
11. User Content
You are solely responsible for any content you transmit or share. We reserve the right to remove content or accounts that violate our policies or the law.
12. Third-Party Services
We use third-party services like Firebase, Stripe, and CallKeep. We are not responsible for their actions, outages, or failures. Their terms apply independently.
13. Intellectual Property
All platform code, UI/UX, logos, and features are the property of BeHeard. Do not copy, clone, or reverse engineer our technology.
14. Termination
We may suspend or terminate your account for violations, fraud, or misuse. You may delete your account at any time.
15. Limitation of Liability
We are not liable for indirect, incidental, or consequential damages. Maximum liability is limited to NZ$100 or the amount you paid in the past 3 months, whichever is lower.
16. Indemnification
You agree to indemnify and hold BeHeard harmless from any claims, damages, losses, or expenses related to your use of the service or your violation of these Terms.
17. Governing Law
These Terms are governed by the laws of New Zealand. Any disputes shall be resolved in the courts of Auckland, New Zealand.
18. Dispute Resolution
We prefer to resolve disputes informally. If unresolved, you agree to binding arbitration in Auckland. Class actions are not permitted.
19. Modifications to Terms
We may update these Terms. Continued use after changes constitutes acceptance of the new Terms.
